These Terms and Conditions ("Terms") form a legally binding agreement between you ("User") and Nolim Studios LLC ("Nolim Studios", "we", "us"), the sole owner and developer of SARA — System for Aviation with Real-time AI ("SARA"). By accessing, registering, installing or using SARA in any form (mobile, web, integrated systems), you accept and agree to be bound by these Terms, our Privacy Policy, and any other policies we provide.

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use SARA. All registration data must be truthful, accurate and kept up to date. You are solely responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

Paid subscriptions are processed through Stripe. All fees, billing cycles, plan quotas, and applicable taxes are described on our pricing page and within the customer portal. Nolim Studios may change pricing or plan features at any time; material changes affecting existing paid subscriptions will be communicated with reasonable notice.

• Plan enforcement: technical limits (messages, AIP lookups, document storage) are enforced by Firestore Plans.
• Upgrades, downgrades, and cancellations are managed via the customer portal when available.
• All fees are non-refundable except where required by applicable law or expressly stated.

You agree not to:

• Use SARA for unlawful, harmful, fraudulent, or malicious activities.
• Attempt to circumvent security, reverse-engineer, decompile, or extract models or data from SARA.
• Scrape, mass-export, or expose SARA data for resale without written consent.
• Rely on SARA as a sole source for operational or safety-critical decisions without verifying against official aviation authorities (ATC, AIP, NOTAM, NOTAMS, etc.).

We process personal data according to our Privacy Policy. We use third-party processors (including Stripe and Firebase products such as Firestore, Functions, Hosting, and Analytics) and may store or process data in multiple jurisdictions. By using SARA you consent to cross-border transfer and processing.

We may retain logs, metadata, and anonymized or aggregated interaction data for service improvement, analytics, compliance and fraud prevention. Where applicable rights exist (access, correction, deletion), we will honor them in accordance with applicable law and our Privacy Policy.

All intellectual property in SARA (including software, user interfaces, APIs, models, datasets, system architecture, documentation, branding, logos, and trade secrets) is owned by Olga Isabel Perez Encarnación, the founder of SARA. Nolim Studios LLC operates SARA as a development and operating partner and does not acquire ownership of SARA’s intellectual property by virtue of development, hosting, operation, or revenue participation. You are granted a limited, revocable, non-exclusive, non-transferable license to use SARA solely in accordance with these Terms. Nothing in these Terms transfers ownership of SARA’s intellectual property to you or to any user, contractor, partner, or third party.

SARA may integrate with third-party services (weather, navigation, databases). We do not control third-party services and disclaim responsibility for their accuracy, availability, or compliance. You agree to comply with third-party terms when using such integrations. Nolim Studios is not liable for errors or outages caused by third parties.

Disclaimer: SARA is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. To the fullest extent permitted by law, Nolim Studios disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of outputs.

Users must verify all operational, safety, legal, and regulatory information with official aviation authorities before acting on it.

To the maximum extent permitted by applicable law, Nolim Studios shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data, goodwill or business interruption, arising out of or related to the use or inability to use SARA, even if Nolim Studios has been advised of the possibility of such damages. Our aggregate liability for direct damages shall not exceed the total amount paid by you to Nolim Studios in the twelve (12) months preceding the claim (or $100 if you have not paid any fees).

You agree to indemnify, defend and hold harmless Nolim Studios, its officers, directors, employees and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of your misuse of SARA, violation of these Terms, or infringement of third party rights.

We may suspend or terminate your access to SARA at our discretion for violations of these Terms, suspicious activity, or where required by law. Termination will not limit our right to pursue other remedies. On termination, your right to use SARA ceases and we may delete or retain your data subject to the Privacy Policy and applicable law.

You agree to comply with all export control laws and sanctions. You will not use SARA in violation of applicable export, economic sanctions or trade laws.

If you believe that any content accessible in SARA infringes your copyright, please contact us at saraapp.dev@gmail.com with a notice containing the information required by applicable law. We will follow our takedown procedures where appropriate.

If any provision is held invalid, the remainder shall continue in full force. Sections concerning intellectual property, indemnification, limitation of liability, payment, confidentiality, and governing law survive termination.

These Terms are governed by the laws of the State of Delaware (USA) without regard to conflict of law principles. Any disputes shall be brought exclusively in the state or federal courts located in Delaware and you consent to such jurisdiction.

We may update these Terms from time to time. Material changes will be posted on this page and, where appropriate, communicated via email to account holders. Continued use after notice constitutes acceptance.

SARA is designed under principles of trustworthy AI for aviation, aligned with emerging international regulatory frameworks, including approaches promoted by bodies like EASA.

The platform is projected as:

• An information assistant, not an autonomous system.
• A tool that strengthens human oversight.
• A scalable standard for secure aeronautical knowledge management.

SARA does not replace the human operator; it amplifies their capacity for access, accuracy, and traceability of information.
